03 — Process

What happens after you call

A criminal file typically unfolds through several stages. Having counsel from the outset often changes the outcome.

  • Arrest or summons. Your rights under the Canadian Charter of Rights and Freedoms apply immediately — especially your right to remain silent and to counsel. Say nothing until you have spoken to a lawyer.
  • First appearance. The charges are read and, if you are detained, a bail hearing is held. Release conditions shape the months that follow.
  • Disclosure. The Crown must disclose all relevant evidence (R. v. Stinchcombe). We review it carefully to identify gaps, inconsistencies and Charter violations.
  • Pre-trial and resolution discussions. Where advantageous, we negotiate — withdrawal of charges, reduced counts, non-conviction outcomes, diversion.
  • Preliminary motions and inquiry. Charter motions, delay applications (R. v. Jordan), preliminary inquiry where eligible.
  • Trial. Before a judge alone or a judge and jury, depending on the offence and your election. Cross-examination, defence evidence, closing arguments.
  • Sentencing & appeal. If a conviction is entered, a sentencing hearing follows. Appeals are available on specific grounds to higher courts.
Important. If the police want to "just ask you a few questions," do not attend alone. Contact us first. The first statement you give is often the most important evidence in the Crown's case.

Your right to a trial in English in Quebec

Under section 530 of the Criminal Code, every accused has the constitutional right to be tried in the official language of Canada of their choice — English or French. In Quebec, this means that proceedings, testimony, motions and judgment can be held in English where you so elect.
